We are going to file a criminal complaint against esPublico. This is how we prepared it.
esPublico sells management software to councils and other public authoritiessource 1. Since 2020 we have been studying its public contractssource 2, mostly with official data that anyone can downloadsource 3. Very soon we will file the criminal complaint. Here we explain what we did, how and with whom. A complaint is not a conviction: only a court can find someone guilty.
The investigation is led by Miguel Ángel Domínguezsource 4, CEO of Add4usource 5, a company that has competed with esPublico for public contractssource 6. Our declaration of interests
In detail
Why it matters
Every year, more than 250,000 public authorities in the European Union spend around €2.6 trillion on services, works and supplies: 15% of the Union's GDPsource 7. It is everyone's money. That is why Spanish law requires every public authority to publish its procurement activity, to ensure transparency and public accesssource 8. This portal is built on that information.
What you will find here
- What we did: the steps of the investigation, each with its date and source.
- How: the official sources, the programs, the AI tools and how to check that no file has changed.
- Who: the people and the machines that have worked on this.
- Data and Search: the contract awards to esPublico published on the Plataforma de Contratación del Sector Público (Spain's official public procurement platform), checked against the Platform twice a daysource 9, each with a link to its official entry.
- Downloads: the dataset, with the hashes to check that it has not changed.
What you will not find yet
We will publish the complaint here when the Public Prosecutor's Office allows us to. Until then, we are not saying which contracts, public bodies or people it mentions, nor giving its figures. The contracts in the search are all the awards to esPublico that we have found in the open data of the Plataforma de Contratación del Sector Público (Spain's official public procurement platform), not a selection made for the complaint.
